網域名稱爭議三要素
 

(1)the domain name registered by the Respondent is identical or confusingly similar to a trademark or service mark in which the Complainant has rights;

(2)the Respondent has no rights or legitimate interests in respect of the domain name; and

(3)the domain name has been registered and is being used in bad faith.

一、 網域名稱與申訴人之商標、標章、姓名、事業名稱或其他標識相同或近似而產生混淆者。

二、 註冊人就其網域名稱無權利或正當利益。

三、 註冊人惡意註冊或使用網域名稱。
